New Orleans, LA (WDSU) - An Alabama man pleaded guilty to two counts of obscenity on Tuesday in connection to an incident in a Bourbon Street restaurant following the BCS National title game in January.
Brian Downing was accused of sexual battery and obscenity in the incident that was caught on video and posted to Youtube.
The video shows downing, wearing a University of Alabama jacket, performing a simulated sex act on an unconscious man after Crimson Tide beat LSU.
Downing had plead not guilty to charges of sexual battery and obscenity.
Prosecutors say the deal was reached before the scheduled start of the trial. As a condition of the plea, downing faces two years in jail. Sentencing will take place on November 29th and it is expected downing will begin serving his sentence that day.
The LSU fan, whose name has not been released is suing Downing, seeking damages for mental anguish, humiliation, embarrassment, anxiety and depression.
Downing's attorney says downing lost his job following the incident and his family is suffering from financial hardship.
