Harvey Updyke turns himself into Lee Co. Deputies

Opelika, AL - The man accused of poisoning the Toomer's Corner oak trees has turned himself into Lee County Deputies.

In a status hearing on Thursday morning, Harvey Updyke surrendered to deputies in exchange for another psych evaluation at Taylor Hardin Secure Medical Center in Tuscaloosa.

Warrants for Updyke's arrest have been put aside after his recent arrest for terrorizing workers at Lowe's in Hammond, Louisiana. A Hammond police officer was in court on Thursday set to testify regarding surveillance video, but did not.

Updyke is scheduled to go to trial in October, but the District Attorney's office expects the trial to be delayed pending Updyke's psych evaluation, which could take weeks.

Updyke is currently being held in the Lee County Detention Facility.
