Opelika, AL - The man accused of shooting six, killing three at an apartment complex in Auburn went back to court in Lee County on Thursday.
23-year-old Desmonte Leonard has pleaded not guilty for six counts including the capital murder of Ladarious Phillips, Ed Christian, and Demario Pitts.
Defense Attorney Susan James says Desmote Leonard is in good spirits after pleading not guilty to capital murder, attempted murder, and assault for the June 19th shooting at University Heights apartment complex.
James says, "I think he knows what the truth is and he's very comfortable with his defense team we are doing everything that we possibly can, the court is being very accommodating so far, because we are appointed all witnesses have to go through the court, so things are going well for his defense."
Leonard is being held at the Montgomery County Jail, but James has filed a motion for a bond hearing, something that's rarely granted in capital murder cases, but James says it's worth a try.
James explains, "Well, we hope he sets a bond that someone can make and with some conditions that would satisfy the court the main thing is its just more efficient to have him in the community when you're working on any criminal case but particularly one of this importance."
The defense says they're preparing as if the death penalty is on the table, given the capital murder charges.
Defense Attorney, Jeff Duffey says, "In a capital murder trial the death penalty is being sought, it's a two tier trial, if there's a finding of guilt, then you have an immediate trial on the penalty phase and you have to be ready for it so whether or not if we like it, we have to prepare for it."
No trial date has been set in this case. Leonards bail hearing is set for November 14th.
The District Attorney's office declined to comment on this case.
