Man in tree scheduled to appear in court

Seattle, WA (KOMO) – The Seattle man who refused to climb down from atop a tree is now refusing to come out of his jail cell.

28-year-old Cody Miller has refused to attend his preliminary appearance.

He skipped out on Thursday’s hearing during which;  the judge decided there is probable cause to hold him until the prosecutor decides whether to charge him with malicious mischief.

The judge is giving him another chance to attend the hearing.

It has been rescheduled for Friday in a special courtroom on the ground floor of the King County jail
